BY CLICKING “I AGREE,” CHECKING A RELATED BOX TO SIGNIFY YOUR ACCEPTANCE, USING ANY OTHER ACCEPTANCE PROTOCOL PRESENTED THROUGH THE SERVICE OR OTHERWISE AFFIRMATIVELY ACCEPTING THIS CONSENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, ACCEPTED, AND AGREED TO BE BOUND BY THIS CONSENT. IF YOU DO NOT AGREE TO THIS CONSENT, DO NOT CREATE AN ACCOUNT OR USE THE SERVICE. YOU HEREBY GRANT AGENCY AUTHORITY TO ANY PARTY WHO CLICKS ON THE “I AGREE” BUTTON OR OTHERWISE INDICATES ACCEPTANCE TO THIS CONSENT ON YOUR BEHALF.

PURPOSE

The purpose of this consent form (“Consent”) is to obtain your informed consent to the use of the online platforms owned and operated by Hims, Inc. (the “Service”) by your minor between the ages of thirteen (13) and eighteen (18). While minors are generally prohibited from using the Service under Hims, Inc.’s Terms and Conditions (the “Terms”), minors between the ages of thirteen (13) and eighteen (18) may use the Service for the sole purpose of obtaining a medical consultation for the treatment of acne using topical prescription skincare products and purchases of non-prescription products available through the Service if a parent or legal guardian provides consent to such uses in accordance with this Consent (the “Minor Service”). Use of the Service is at all times subject to the Terms.

YOUR ACKNOWLEDGMENTS

By clicking “I Agree”, checking a related box to signify your acceptance, using any other acceptance protocol presented through the Service or otherwise affirmatively accepting this consent, you are agreeing and providing your consent with respect to the following: The minor for whom you are the parent or legal guardian may use all aspects of the Minor Service without the need to obtain additional consent from you and regardless of whether such use is conducted in or outside of your presence, including but not limited to providing data, images (including photographic images of the affected skin area), and other information required by the Service, undergoing consultations with healthcare providers through the platform (which may include a video and/or phone conversation), and interacting with customer service representatives or other Hims, Inc. representatives through the Service. You will receive certain notices regarding your minor’s use of the Minor Service via the email or phone number indicated at account creation for the parent or legal guardian, which may include notice of purchases, changes to prescription formulas, and changes to shipment cadence. It is your responsibility to keep your contact information accurate and up-to-date in the Service, and to monitor and review notices provided to you. Access to the customer account itself is enabled only through the primary email address and password used to create the account. If you need to access the account and do not have the primary login credentials, or if you wish to withdraw your consent for your minor child’s use of the Minor Service, please contact customer service. You will be required to provide proof of guardianship to access or withdraw consent through customer service and any withdrawal of consent will only be effective upon receipt of the Service’s required proof of guardianship. Any withdrawal of consent will apply only to actions taken after effective notice of such withdrawal.
